COOLED TRANSPORTED SEMEN

This agreement made and entered into this _____day of________2006, by and  between __________________________________(Stallion Manager) and  ___________________________________________(Mare Owner), and shall be subject to the following terms and conditions:

1. Mare Owner hereby agrees to breed the following Mare:

Using cooled transported semen, to ________________________________during the 2006 breeding season, which begins February 1st and ends July 30th.
2. The Stallion Service Fee of $1,000.00 is payable in full, before any semen will be shipped. PLEASE MAKE CHECKS PAYABLE TO FLYING C BAR RANCH.
3. A copy of both sides of the Mare’s Registration paper shall accompany the executed Agreement. The record Owner or Lessee will be reported on the Stallion Breeding Report.
4. A Collection and lab fee of $100.00 will be charged on the first shipment. Each subsequent shipment will cost $100.00, and shall be prepaid.
5. Shipment will be by Federal Express Overnight Delivery. If a Saturday or holiday delivery is required and available, additional charges may be applied.
6. Under no circumstances will the shipment be collected unless the Mare Owner has provided the Stallion Manager advance notice by 9:00 AM Central Time on the day of shipment and all charges due and payable herein have been paid in full.
7. Mare Owner agrees that a certified veterinarian experienced in cooled semen will inseminate the Mare, complete all required forms and return them to the AQHA within the 15 day time period required by the AQHA. Mare Owner also agrees to use all Cooled Semen provided by this Agreement for the Mare named herein and no other.
8. Mare Owner is responsible for pregnancy checking the Mare on or before 18 days and notifying Stallion Manager of the results.
9. The Stallion Service Fee on transported semen is non-refundable. However, Stallion Manager does give a “Live Foal Guarantee”, defined as a foal that stands and nurses without assistance after foaling. Mare Owner must notify Stallion Manager within 48 hours after the time of foaling if the Mare did not produce a live foal. Within 14 days after such notice, Mare Owner must provide Stallion Manager with certification that foaling was an attended birth, accompanied by a statement from a licensed veterinarian giving the particulars required to substantiate the failure of the Mare to produce a live foal, that the insemination was conducted in accordance with this Agreement, and that the loss of a live foal was not due to the Mare Owner’s negligence.
10. If the contracted Mare does not settle or aborts the first year, Stallion Manager will only honor an “on premises” breeding. “On Premises” breeding means the Mare shall be delivered to Stallion Manager for breeding. Board charges and other expenses incurred will be charged.
11. Mare Owner agrees that the Mare will not be returned to performance training or showing after the Mare has been inseminated, until such time as she foals.
12. Stallion Manager makes no guarantee of delivery within a certain time period or that the cooled semen will safely reach the insemination point without losing integrity, quality, or characteristics, but will make a diligent effort to achieve same.
13. This Contract shall be binding upon both parties, and may not be transferred or assigned.
14. This Contract is entered into in the State of Oklahoma and will be interpreted and enforced under the laws of the State.
